Mysha India Services (P) Ltd. will be referred to as  “Mysha” and the customer will be referred to as “You”.
Before using the website, You are required to go through the User Agreement and accept all the Terms and Conditions

Terms and Conditions:
Mysha sets forth the terms and conditions under which information is provided on this website as well as the use of this website by You. By using this site, it would be presumed that you have gone through the details of the terms and conditions of usage and have agreed to abide by them. If you do not agree to any of the provisions of the said terms and conditions, then do not use the site.
By agreeing to the terms and conditions, “You” will be the natural or legal person who has agreed to register on this website and have become a member. It will be deemed that you have agreed to this electronic record of the User Agreement and have allocated to yourself a unique “Username” and “Password” for identification on this website.

Eligibility:
Persons, above 18 years of age and having a valid passport, can access this website for information and to make a booking. You will have to comply with RBI guidelines and Government of India rules.
The documents listed below have to be filled, signed and returned to us with the applicable documents, photographs, initial deposit and any other requirement mentioned in the Terms and Conditions:

 In cases where travellers belong to more than one family under a single form, the form shall be signed by the head / authorized person of each family. This shall be taken as acceptance with full responsibility for and on behalf of all the booked persons
Signing of the Booking Form and Terms and Conditions and initial booking amount accepted towards the Tour Cost and receipt issued for the same will be a legally binding contract between parties
You can use this website only to make genuine reservations and not use it for false, fraudulent, fictitious reservations
While using this website you, alone, are responsible to maintain the confidentiality of your account information, username and password.

Ownership:
All contents and materials on this site are protected by copyright laws. Any unauthorized usage of the content and material will be subject to copyright laws
Mysha does not guarantee the accuracy of information provided on this website and under no circumstances will Mysha be responsible  or liable for any loss or damages caused by reliance on this information. Any information on this website can be changed, updated, withdrawn without prior notice.

How To Book:
Mysha products, online or offline, are sold subject to certain Terms & Conditions. These are amended from time to time, without prior notice, and the agreement between You and Mysha will be governed by the same.
If Mysha makes any third party product booking for you, the third party’s Terms and Conditions will be applicable and added to our Terms & Conditions.

•    Each party has to fill and sign the Booking Form and Terms & Conditions form..
•    In cases where travellers belong to more than one family under a single form, the form shall be signed by the head / authorized person of each family. This shall be taken as acceptance with full responsibility for and on behalf of all the booked persons
•    If a Travel Agent is processing your booking, you have to make all the payments to the Travel Agent and he shall pay Mysha on your behalf
•    A copy of your Pan Card / Form 60 and Income Tax declaration in case of cash payment of Rs.20000.00 and above

Payment and Schedule:

When you are ready to proceed with the reservation, you will have to pay

30 % of the total tour cost as an advance
100% payment required for train and flight bookings
100% payment required for booking third party products

On receipt of the advance amount and the signed booking form, terms & conditions form, the booking process will be initiated and updated information will be sent to you
70% balance amount has to be paid on receipt of the reservation status and, at least, 30 days before commencement of the tour.

Mysha will send an invoice. The invoice will have details of the costs associated with the tour – called the “Tour Price”- and shall include the cost of the products and services which will be provided to you during your holiday travel, related expenses and applicable taxes

On receipt of the full amount, the hotel / transport  vouchers, air / train tickets, any other travel associated documents will be sent across to you through post or email.

If the booking is made and confirmed within 30 days of the date of departure, then the full  (100% ) amount of the tour has to be paid at the time of booking

Payments made online on the Mysha website are secure. Mysha does not store the Credit Card details of any customer in any data backup or retrieval system. Once a customer is ready to make an online payment he is directed to the bank site. The credit card details are captured on the bank / credit card site and not on the Mysha website, hence, Mysha cannot be held responsible for any misuse of the credit card whatsoever.

Amendment in Prices / Change in Exchange Rates:

If there is any error or miscalculation, technical or otherwise, in the prices quoted and mentioned in the invoice, then Mysha may charge or claim additional payment from you or refund the excess amount to you within a reasonable period of time.

Also note that prices of the travel itineraries mentioned on Mysha’s website are subject to change

Kindly note that the Tour Price is calculated as per the prevailing current rate of exchange on the date of the booking or tour contract and once you accept the price there will be no change in the Tour Price regardless of fluctuations or variations in the exchange rate of the relevant currencies

Services:
Mysha agrees to provide to you the services that have been discussed and finalized or mentioned on the website. The details of the services will be given in the travel confirmation

Amendments:
Mysha reserves the right to alter, modify, change , amend or deviate from the tour services mentioned in the travel  confirmation after finalization and acceptance by you of the Tour Contracter, but before commencement of the tour
These amendments / changes may be carried out by Mysha due to cancellation of certain services, bookings by the third party service provider, non availability of packages or services requested by You, insolvency or closure of business of the third party provider or any other reason on account of unforeseen circumstances.
Mysha will keep You informed of such developments before commencement of the tour.

Refund:
If the entire tour or part of the tour cannot be completed or conducted because of Force Majure or Vis Majure, Mysha shall not be responsible or obliged to refund to You. However, at its sole discretion, Mysha gives refunds based on certain factors like the number of participants and suppliers cancellation policies. The decision of Mysha on the quantum of refund is final.
In case of a Force Majure event, Mysha reserves the right to change, modify, alter the tour itinerary and tour price accordingly. Any such change shall be intimated to you and additional charges, if any, will be collected from you.
In  a Force Majure event, if You choose to continue with the tour, Mysha will not be entitled to give You any refunds for limitation and or non availability of certain services including museums, restaurants, sightseeings, excursions, shopping etc., although included in the tour itinerary.
There shall be no refund if the Client does not utilize any of the services like hotels, sightseeing, cruises and any other services for whatever reason.

Cancellation and Refund:
Any cancellation has to be intimated in writing. If You cancel a tour, the following cancellation charges will be applicable:
30 days or more before start of tour        : 25% of the tour amount
Less than 30 days and more than 15 days
before start of tour                : 40% of the tour amount
14 days to 8 days before start of tour        : 50% of the tour amount
Less than 8 days before start of tour        : 100% of the tour amount

In case of third party products, the rules related to cancellation and cancellation schedule
prescribed by the third party service provider would be applicable. Mysha shall have the
right to claim service and communication charges of Rs. 5000.00 per person    

Mysha is a travel organizer and coordinator. We do not own, operate or control any airline, hotel, transport, shipping line or any other service mentioned on the website. Hence, we cannot be held responsible for any shortfall in the service levels of any airline, hotel, transport etc.

Insurance:
Mysha advises its customers to acquire adequate medical, health and travel insurance policies. It is mandatory to purchase an Overseas Mediclaim and other Insurance Policies to cover any risks to life, limb and property.

Governing Law:
All legal disputes will be settled under the laws of Indian courts subject to the laws of the Republic of India. In the event of any dispute of whatever nature, arising under this Agreement, such dispute shall be settled through negotiation and good faith among the parties. In case such dispute cannot be resolved by negotiation within 30 days, such dispute shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act 1996. The place of arbitration shall be New Delhi, India. The decision of the arbitral tribunal shall be final and binding upon the parties. In case of the dispute requiring intervention of courts, courts in New Delhi alone shall have exclusive jurisdiction.

Passport and Visa Requirements:
It is your responsibility to ensure that You hold a passport which is valid for a minimum period of 6 months from the date of return of your trip.
You should acquaint yourself with all required information and details relating to visa requirements and the rules governing travel in the country You wish to visit.
You shall be required to obtain the visa yourself. However, in limited circumstances, Mysha shall assist you in procuring the visa.
Cost of the relevant visa is not included in the tour cost and has to be paid as a supplement cost.
Mysha is not liable nor can be held responsible if your visa application is rejected by the Embassy or Consulate

Indemnity:
You (The Indemnifying Party) agree to indemnify , defend and hold harmless, Mysha, its directors, consultants, employees, agents, other officers from and against any and all losses, liabilities, claims, damages, costs, expenses against or incurred by the Indemnified Party that arise out of, result from, or may be payable by virtue of any breach or non – performance of any representation, warranty or agreement made or obligation to be performed by You pursuant to these conditions or any additional terms set out in the Tour Contract.
The indemnity contained in the above is without prejudice to and in addition to any remedies or rights provided by law and / or statute and / or under any provision of these conditions.

Privacy Policy:
Mysha respects your privacy and recognizes the need to protect any identifiable information that you share with us.  However, it would be necessary for us to share this information with Consulates, Embassies, Airlines, Hotels and other service providers who would be providing you service during the tour. We would also be constrained to disclose such information if we receive an order of the court, a requisition from any government or statutory authority, subpoena, or under any law, rules or regulations, such disclosure becomes necessary. The company reserves the right to publish photographs / letters / web pictures /videos / emails taken by you during the tour and also to track usage statistics.

Termination of Agreement:
Mysha may terminate this User Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this site or your failure to comply with these terms and conditions. Such termination shall not effect any right to relief to which Mysha and its third party providers and distributors may be entitled, at law or in equity.
